Abstract
The clarity and transparency of the judicial decision-making process is one of the most important factors in empowering judges to reach a valid decision in any legal system. Departing from the assumption of this meaningful relationship, theoretical and legal studies in the theories of proceedings indicate the existence of common variables affecting the equation of judgment in different theories of proceedings. With a descriptive-analytical method, this research has investigated the influence of variables such as the concept of law, the ratio of rights and ethics, communication proceedings and judicial policy on the process of proceedings in courts.
