Adopting an appropriate legal approach to support stem cell research significantly influences investment attraction and innovation in this field. Assuming that stem cells and related innovations are patentable under the patent system and meet the necessary patent requirements, it remains to be examined whether such inventions constitute exceptions based on good morality (akhlaq-e hasanah) and public order. Addressing this question, according to both jurisprudential arguments and statutory provisions, hinges on whether a fertilized cell can be regarded as an embryo or the beginning of human personhood. This article, by analyzing both the jurisprudential approach and legal regulations and examining the concept of morality, concludes that since classical jurisprudential arguments require implantation in the womb for legal effect, laboratory embryos do not fall under prohibitive provisions.
