At criminalization stage the legislator should choose the appropriate punishment for the desired crime according to the some principles and criteria. One criterion is the existence and reality of man who is endowed with the dignity and honor of God, and the other is a human act that may be favorable or Undesirable. In this paper, we try to explain how the appropriate penalty is justifiable in the legislation in light of the principle of human dignity. This is based on the basic principle in criminal law which is the connection between the penalty, criminal and his conduct. In the end, according to this principle, there are criteria for choosing the penalty in terms of type and measure, such as the criteria of proportion for delinquency and punishments in which different schools may have different influences.
