Abstract
Considering the contrast between the open-source legal approach and the intellectual property law system, as the prevailing legal framework in the field of innovation in Iranian regulations, the application of this approach in our country’s law depends on a serious evaluation from various aspects and the justifiability of this matter after comparison with this system. In this regard, based on the silence of the regulations regarding the identification and clarification of the principles and essential components of knowledge dissemination, it is necessary to act according to the jurisprudential rules of knowledge dissemination. According to the research findings, the intellectual property law system, in its current situation, constitutes one of the obstacles to the realization and application of jurisprudential rules related to knowledge dissemination, namely the rule prohibiting concealment of knowledge, the rule obliging the dissemination of knowledge, and the rule of referring the ignorant to the knowledgeable. However, the scope of these rules encompasses the main elements of the open-source legal approach; therefore, based on the compatibility of the open-source legal approach with these rules, these jurisprudential principles provide the grounds for the acceptance and application of this approach in Iranian positive law in a proportionate manner, i.e., in cases of necessity and special importance, justifying and demonstrating it effectively.
