تحلیل حقوقی ارتقای امنیت قراردادها از طریق فناوری بلاک‌چین در نظام حقوقی ایران

چکیده
قراردادهای سنتی با چالش‌هایی نظیر جعل، دستکاری و انکار تعهدات مواجه‌اند که امنیت حقوقی طرفین را تهدید می‌کند. فناوری بلاک‌چین به‌عنوان نوآوری نوظهور در حوزه ثبت اطلاعات، ظرفیت‌هایی برای رفع این چالش‌ها ایجاد کرده است. پژوهش حاضر با هدف تحلیل حقوقی ارتقای امنیت قراردادها از طریق فناوری بلاک‌چین در نظام حقوقی ایران انجام شده است. یافته‌ها نشان داد که بلاک‌چین با ویژگی‌های تغییرناپذیری، شفافیت و غیرمتمرکز بودن، توانایی کاهش جعل و تقلب در قراردادها را دارد. بررسی انطباق ارکان صحت معاملات موضوع ماده ۱۹۰ قانون مدنی با این فناوری حاکی از آن است که بلاک‌چین فی‌نفسه مانعی برای تحقق این ارکان ایجاد نمی‌کند، هرچند احراز اهلیت طرفین نیازمند سازوکارهای تکمیلی است. در مقابل، موانعی نظیر خلأهای قانونی، عدم شناسایی رسمی اسناد بلاک‌چینی و فقدان زیرساخت‌های نهادی، پذیرش این فناوری را با چالش مواجه ساخته است. نتایج حاکی از آن است که بهره‌مندی از مزایای بلاک‌چین در ارتقای امنیت قراردادی، مستلزم بازنگری در قانون تجارت الکترونیکی و تأسیس نهاد تنظیم‌گر تخصصی است. روش تحقیق برای حل مساله کتابخانه ای و توصیفی و تحلیلی است.
