تونل نظامی و چالش اعمال هنجارهای حقوقی حاکم بر مخاصمات

چکیده
یکی از ابتکارات نوین به‌کاربرده شده در جنگ جهت ایجاد توازن قوا میان طرفین، حفاری و ساخت تأسیسات نظامی زیرزمینی بوده است تا گروه‌ها و بازیگران مسلح دولتی و غیردولتی ضعیف‌تر با هدایت طرف مقابل خود به داخل فضای سربسته و تاریک، توانمندی نظامی و تسلیحاتی آنان را سلب و محدود نمایند. لیکن در این میان متخاصمین با چالش‌های گسترده‌ای در تقابل با چنین سازوکاری مواجه‌اند که سؤالات معتنابهی ایجاد کرده است. زمانی‌که هیچ یک از فرماندهان و نظامیان از آنچه در زیرزمین در حال جریان است، باخبر نیستند، انتخاب تسلیحات متعارف و مشروع جهت مقابله با چنین جنگ‌افزاری بسیار ابهام‌برانگیز می‌شود و از طرفی امکان رعایت برخی اصول بنیادین حقوق بشردوستانه تحت‌الشعاع قرار می‌گیرد. پژوهش حاضر با اتکا به تحلیل منابع توصیفی مترصد تبیین جملگی محظوراتی است که از قبل سازه‌های زیرزمینی حادث شده است. این تحقیق در پی پاسخ به سؤال اصلی خود مبنی بر چگونگی اعمال اصول حقوق بین‌الملل بشردوستانه در تونل‌های نظامی و عملیات‌های پیرامونی آن نتیجه می‌گیرد عاملان نظامی برای اطمینان کامل از رعایت حقوق حاکم بر مخاصمات مسلحانه در هدایت حمله به سمت نظامیان مستقر در تونل‌های نظامی و عدم سرایت آسیب به جمعیت غیرنظامی داخل یا مجاور آن، ناگزیر به تائید کامل ماهیت هدف و آنچه که درون آن می‌گذرد می‌باشند که جز با تحصیل و تجمیع اطلاعات و همچنین نظارت و شناسایی قابل انجام نیست.
