Considering that there is no text or research about the reluctance of a young boy to commit murder due to his mistake in the target; therefore, investigating this issue and its foundations is considered to be of special importance and a new research. Interestingly, the basic principles of jurists regarding both legal and criminal issues refer to the case of the child's will and free will, not the case of his reluctance. The Islamic Penal Code has also considered the mere reluctance of a young boy to be the reason for his reasonable responsibility and the reluctance's imprisonment. Therefore, proving the intentionality of the involuntary crime of a young boy who was committed under his reluctance, intention and will can lead to a new clause in the penal law. The present research, through the use of descriptive-analysis method, scrutinizes the responsible factor in assuming the reluctance of the auditor boy and his mistake in the goal. معیت اکراه و اشتباه در هدف در باره صبی ممیز ازجمله امور نادری است که در فقه و حقوق بررسی نشده است؛ هرچند این امر نافی تحلیل‌ها و تفصیل‌ها در مورد اکراه یااشتباه در هدف به طور جداگانه نیست. با توجه به اینکه نص و پژوهشی در مورد اکراه صبی ممیز به قتل مقارن با اشتباه او در هدف وجود ندارد؛ لذا بررسی این مسأله ومبانی آن دارای اهمیت ویژه و پژوهشی نو وجدید به حساب می آید. جالب اینکه اصول مبنای فقها در مورد هر دو مسأله-حقوقی و جزائی- به مورد عمد و اختیار صبی اشاره دارد نه مورد اکراه او. قانون مجازات اسلامی نیز صرف اکراه صبی ممیز را موجب مسئولیت عاقله او و حبس اکراه‌ کننده دانسته است. از این رو اثبات عمدی بودن جنایت اکراهی صبی ممیز که تحت اکراه ،قصد و اراده او زایل شده است می‌تواند باعث بند جدیدی در قانون مجازات شود، علاوه بر نصوص، ادله عقلی و عرفی مؤید این نظر است. پژوهش پیش رو موضوع مسئول نهایی در جنایات خطائی صبی ممیز مکرَه در موارد اکراه و خطای او در اصابت را به مدد روش تحلیلی توصیفی مورد مداقه قرار میدهد. https://hoquq.iict.ac.ir/article_722879_4192f93130bf9cb448ca12df9f33bfa1.pdf
