However, quite a number of jurists and legal jurists have provided evidence against rejection of interest hypothecation and have even seen it valid and necessary. But none of them have so far presented any details, effects, and rules of the aforementioned institution. Therefore, it is essential to further investigate interest hypothecation, especially considering the different nature of this kind of hypothecation from object hypothecation with regard to contract conditions, effects, and rules of it.<br>Putting all this together, and while agreeing with idea of the aforementioned group of jurists and legal jurists, this study (of course now in the stage of "conclusion") was an attempt to offer the legislator a system to govern mortgage of interest, thereby properly determining the legal details of it and subsuming it under the Mortgage Contract (not Article 10 of Civil Code) along with its effects and rules. Indeed, it will be a proposed institution to improve the perspective of Iran's legal system in wich the corollary will be the acceptance of interest mortgage رهن منفعت در نظام فعلی حقوقی، به حکم قانون مدنی مصوّب 1308 باطل است. از سوی دیگر بسیاری از فقها و حقوقدانان بر این نظر، به طور مستدل، خدشه وارد آورده و صحّت این نهاد را امری محتمل، بلکه ضروری دانسته‎اند؛ لکن هیچ‏‎یک از ایشان جزئیات، آثار و احکام نهاد مزبور را بیان ننموده است. در حالی که ترهین منافع (در فرض پذیرش آن در اصل،) از حیث چگونگیِ انعقاد و برخی آثار و احکام دیگر در وضعیتی متفاوت با رهن عین بوده و این امر، ضرورت بررسی جداگانه‎ای را در این خصوص می‎طلبد.<br>نگارندگان در این پژوهش، ضمن تأیید عقیده این گروه از فقها و حقوقدانان، تلاش نموده‎اند نظامی را به منظور وثیقه‎گذاری منافع اموال، به مقنّن پیشنهاد نمایند که بتواند جزئیات عمل حقوقی ترهین منافع را (البته اکنون در مرحله انعقاد و آثار) به گونه‎ای هماهنگ بیان نموده و در عین حال ذیل عقد معین «رهن» (و نه مادة 10 ق.م.) با تمام آثار و احکام آن قرار گیرد: نهادی پیشنهادی برای دورنمای نظام حقوقی کشور که فرعِ بر پذیرش رهن منفعت در اصل می‎باشد. https://hoquq.iict.ac.ir/article_713383_53ea5c1642df42a85dff1ead9ff9ce75.pdf
