علی‌اکبر رشاد حقوق اسلامی 1735-3270 18 71 2022 01 21 An International Law analysis of the Guardian Council's Views on Reservation Concerning the Palermo and CFT Conventions تحلیل حقوقی بین‌المللی دیدگاه شورای نگهبان در زمینه اعمال حق شرط بر کنوانسیون‌های پالرمو و CFT 175 204 251399 FA عبدالله عابدینی عضو هیأت علمی پژوهشکده تحقیق و توسعه علوم انسانی (سمت) Journal Article 2021 06 09 In the process of Iran's accession to the United Nations Convention against Transnational Organized Crime, known as the Palermo Convention (hereinafter the Palermo Convention) and the International Convention for the Suppression of the Financing of Terrorism (hereinafter the CFT Convention), the Guardian Council has, among the others, two objections regarding the non-accession to the two instruments. First, concerns about potential impediments on the circumvention the United States sanctions and second, obstructing assistance to resistance groups. Given the common provisions of both Conventions on the fulfilment of obligations under the domestic standards of the Member State, there seems to be no reason to worry about them. In this article, while examining the reservation of other States to these instruments, it will be analysed in light of international law rules the Guardian Council's objections to the proposed reservation to the Conventions. The conclusion is that the concerns raised about accession to the conventions can be eliminated in the light of the principles and rules of international law based on the objections raised. در راستای فرایند الحاق ایران به «کنوانسیون سازمان ملل متحد علیه جرائم سازمان‌یافته بین‌المللی» موسوم به کنوانسیون پالرمو و «کنوانسیون بین‌المللی در مورد سرکوب تأمین مالی تروریسم»، شورای نگهبان در میان سایر ایرادات وارده، دو ایراد اصلی در خصوص عدم الحاق به دو سند مزبور مطرح کرده است: 1- نگرانی از بسته شدن منافذ دور زدن تحریم‌های ایالات متحده؛ و 2- ایجاد مانع بر سر کمک به گروه‌های مقاومت. با توجه به مفاد مشترک هر دو کنوانسیون مبنی بر انجام تعهدات بر اساس موازین داخلی دولت عضو، به نظر می‌رسد دلیلی برای نگرانی در خصوص مورد دوم وجود نداشته باشد. اما در هر حال، مورد نخست می‌تواند با توجه به درخواست اطلاعات مالی، بانکی و غیرمالی و غیربانکی، محل تأمل باشد. در این نوشتار ضمن بررسی حق‌شرط‌های دولت‌های دیگر به این دو سند، در پرتو موازین حقوق بین‌الملل، به تجزیه و تحلیل ایرادات شورای نگهبان بر حق شرط‌های پیشنهادی بر دو کنوانسیون می‌پردازیم. نتیجه‌گیری مباحث آن است که نگرانی‌های مطرح شده در خصوص الحاق به کنوانسیون‌ها بر مبنای ایرادات وارده، در پرتو اصول و قواعد حقوق بین‌الملل قابل رفع هستند. https://hoquq.iict.ac.ir/article_251399_626a35e3e924520f8833d676da85754e.pdf
