In case of communicable diseases(such as corona), public and government officials are usually warned, and patients with both non-patients and non-patients are advised to avoid contact with each other and not to enter public places. So one question is whether general(non-government) caution by the public is detrimental to civil liability. And given that the warning audience is often uninjured (non-sick) and causal (patient) and the transmission of the disease requires both actions to be taken according to the warning, what is the contribution of the injured party to the responsibility and the intersection of the "rule of action"? And where is the "warning rule" on this issue? If there is a conflict between performing the act according to the warning(for example, not entering the public environment) with other actions that are beneficial to the victim or deter him from harm, what is the obligation?In this article, according to the jurisprudential documents, the rule of warning is characterized by the activity of notarizing the revocation and the theory of the adequacy of the warning operation by everyone is accepted in the elimination of the guaranteed guarantee. The warranty loss(carrier of an infectious disease) where the injured party is unable to act in accordance with the warranty(due to conflict with other damages) and the injured party is unable to act in accordance with the rule of action.}, keywords = {warning,Infectious Disease,CORONA,Action,Civil Liability}, title_fa = {امکان سنجی رفع مسئولیت مدنی ناقلان بیماریهای همه‌گیر(کرونا) در پرتو قاعده تحذیر}, abstract_fa = {مطابق قاعده تحذیر هرکس قبل از اقدام به عملیات زیانبار به سایرین هشدار دهد، با وجود شرایط لازم از مسئولیت‌مدنی معاف خواهد بود. در مسئله بیماریهای واگیردار(مانند کرونا) معمولاً تحذیر از جانب مقامات عمومی و دولت صورت می‌گیرد و مخاطب تحذیر بیماران و غیر بیماران بصورت توأمان هستند که به آنها توصیه به عدم تماس با یکدیگر و عدم ورود در محیط‌های عمومی می‌شود. بنابراین یک مسئله این است که آیا تحذیر عام از جانب غیر عامل‌زیان (دولت) رافع مسئولیت‌مدنی زیان‌رساننده می‌باشد یا خیر؟ و با توجه به اینکه مخاطب تحذیر صورت گرفته غالباً زیان‌دیده(غیربیمار) و عامل‌زیان (بیمار) می‌باشند و انتقال بیماری نیاز به ترک عمل مطابق تحذیر از جانب هر دو دارد، زیان‌دیده در مسئولیت بوجود آمده چه سهمی دارد و نقطه تلاقی «قاعده اقدام» و «قاعده تحذیر» در این مسئله کجاست؟ چنانچه میان انجام فعل مطابق هشدار (مثلاً عدم ورود به محیط عمومی) با افعال دیگری که برای زیان‌دیده منفعت دارد یا ضرری را از وی دفع می‌کند، تزاحم رخ می‌دهد تکلیف چیست؟ در این نوشتار با توجه به مستندات فقهی قاعده تحذیر، از فاعلیت محذر الغاء خصوصیت شده و نظریه کفایت عملیات تحذیر از جانب هرکسی، در رفع ضمان پذیرفته شده‌است و با تفکیک مواردی که عامل‌زیان از اسباب مردد است از مواردی که از اسباب یقینی است، بر ضمان زیان‌رساننده (ناقل بیماری واگیردار) در جایی که زیان‌دیده قادر بر عمل مطابق تحذیر (بدلیل تزاحم با ضررهای دیگر) نیست و بر محرومیت زیان‌دیده قادر بر عمل به تحذیر از تدارک خسارتش بدلیل قاعده اقدام، استدلال شده‌است.}, keywords_fa = {تحذیر,هشدار,بیماری واگیردار,کرونا,اقدام,مسئولیت مدنی}, url = {https://hoquq.iict.ac.ir/article_40494.html}, eprint = {https://hoquq.iict.ac.ir/article_40494_cde9200902f177e4c4eaa94f0124e37d.pdf} }
