چکیده
نظام حق اختراع بر اساس مبانی خاصی شکل گرفته که از جمله آنها ایجاد انگیزه در مخترع و احترام به کار اوست. در مقابل مبانی دیگری همانند رقابت وجود دارند که با مبانی مذکور در تزاحم بوده و البته مقدم بر آن مبانیند. با توجه به اینکه قانون ثبت اختراعات، طرح های صنعتی و علایم تجاری ایران به تبع دیگر قوانین حقوق مالکیت فکری موجود در کشور های جهان، راه حل رفع این تزاحم را در به رسمیت شناختن استثنائات بهره برداری از حق اختراع می داند و در بند ج ماده 15 خود، این استثنائات را احصا می کند این مقاله در صدد است با استفاده از اسناد کمیته دائمی حق اختراع وایپو و دیگر اسناد موجود، مبانی خاصی که با مبانی ایجاد کننده حق اختراع در تزاحم بوده و پذیرش استثنائات را موجه می سازد روشن سازد. لذا بنظر می رسد مبانی استثنائات بهره برداری از حق اختراع در 5 بخش کلی مبانی اقتصادی، حقوقی، فرهنگی و اجتماعی، سلامت و امنیت و نیز در چارچوب مبانی فقهی قابل بررسی است.
