The Islamic republic of Iran’s legislators, based on the call of the people, accepted Islamic principles as the principles and rules of the society so that they would be able to form legal and temporary gatherings to express their opinions and demands. The 27th constitution, to form temporary or public gathering, two conditions – absence of any weapons and no disruption to the principles of Islam – are necessary so that no disorder to the religion that is the basis of this country and no harm to the security of the country which is the citizens fundamental right is inflicted. It seems that legislators and law executors shouldn’t oblige previous notice or permit, which is clearly contrary to law, from the ministry of interior for uprising assemblies and march. If they do wish to continue on this path – to not permit disorder to the system and Islamic principles – it is worthy (whether through the principles of this matter or legal interpretation of the guardian council in connection with this principle or even changing of this principle) that they should just close the door to legal oppositions to exert freedom and forming assemblies and marchs.}, keywords = {"Assemblies","Permit","Islamic principles","March","Freedom"}, title_fa = {آزادی تشکیل اجتماعات و راهپیمایی‌ها در پرتوِ اصل 27 قانون اساسی ایران}, abstract_fa = {نیاز به معاشرت و همدلی با افراد دیگر جامعه، از اساسی‌ترین نیاز‌های بشر است. خداوند عزوجل «آزادی» را در انسان به ودیعه گذاشت تا انسان بتواند با اختیار خود، در هر زمان و مکانی به انسان‌های دیگر بپیوندد. قانونگذار اساسی جمهوری اسلامی ایران نیز این حق را برای ایرانیان به رسمیت شناخت تا بتوانند برای تبادل دیدگاه‌ها و بیان مطالباتشان، اجتماعات قانونی موقتی تشکیل دهند. بر اساس اصل 27 قانون اساسی ایران، برای تشکیل اجتماعات موقتی یا عمومی، دو شرط «عدم حمل سلاح» و «عدم اخلال به مبانی اسلام» ضروری است. شاید به ‌همین ‌دلیل باشد که با وجود عدم تصریح قانون اساسی به ضرورت اطلاع وزارت کشور، این امر برای تشکیل راهپیمایی ـ که روشن‌ترین مصداق تشکیل اجتماعات موقتی در کشور ماست ـ الزامی بیان شده است تا بر حصول این دو شرط نظارت شود. به‌ نظر می‌رسد قانونگذار و مجریان قانون برای تشکیل اجتماعات و راهپیمایی‌ها نباید خلاف صریح قانون اساسی، اطلاع یا دریافت مجوز از وزارت کشور را الزامی کنند و اگر هدفِ عدم اخلال به نظام و مبانی اسلام را دنبال می‌کنند، شایسته است از راه وضع اصل جدید در این ‌باره یا از راه تفسیر قانونی شورای نگهبان، یا حتی تغییر این اصل، راه را بر ایجاد موانع قانونیِ اِعمال آزادی تشکیل اجتماعات و راهپیمایی‌ها ببندند.}, keywords_fa = {اجتماعات,مجوز,اخلال,مبانی اسلام,راهپیمایی,آزادی}, url = {https://hoquq.iict.ac.ir/article_27503.html}, eprint = {} }
