This is a descriptive-analytic study based on library resources while explaining jurisprudential views of Imamiyeh jurisprudents and Sunni jurists on the legitimacy of gene therapy. There are three views that are prohibition, licensing and conditional licensing the Imamiyeh jurisprudents believe in, namely, gene therapy through couple's genes and by some conditions while absolute prohibition is the prevailing view of Sunni jurists. Conditionally, in manipulation and modification the sperm of a male with another male gene ,the male can not be a father and only the husband is the father.
