In this regard, transparency is one of the clear qualifications of the competent ruler which, as an efficient mechanism supporting political, economic, social, and cultural rights of the citizens, can bring the power to the expected point and be a valuable means to fight inauspicious phenomena such as political and economic corruptions which are among the most important legal and political challenges every society face. Though the legal concept of transparency is a new one, its roots may be found in Alawi teachings and in particular in his short period of ruling. Ali (a) thought as transparency in ruling as a necessity and spoke o his governmental idea and actual way of ruling frankly and explicitly. Except for war secrets, he did not consider secrecy as being permitted. In Alawi thought, some Indicators and standards- whether structural or behavioral-  are involved which provide a ground for realizability of transparency, public good, and public interest. Explicitly stating the state’s positions, alarm to the agents of the states, explaining rights and duties of the agents and people towards each other, necessity of easy access to the agents, employing high level standards of honesty and morality for employees of the state, informing people and explicating reasons behind punishing agents are behavioral Indicators of a transparent state. Also, employing structural indicators such as covering supervision net as well as an independent juridical system may be useful in attaining transparency.}, keywords = {Alawi thought,State,Transparency,structural indicators,behavioral indicators}, title_fa = {شاخص‌های شفافیت در حکومت اسلامی (با تأکید بر حکومت علوی)}, abstract_fa = {یکی از مهم‌ترین تعهدات حکمرانی شایسته، تضمین حقوق بشر و شهروندی می‌باشد و در این جهت، «شفافیت» یکی از خصایص روشن حکمرانی شایسته است که می‌تواند به عنوان سازوکار مؤثر حامی حقوق سیاسی، اقتصادی، اجتماعی و فرهنگی شهروندان، قدرت را به نقطه تراز مورد انتظار برساند و راهکاری ارزنده برای مبارزه با پدیده‌های شومی باشد مانند فساد‌های سیاسی و اقتصادی که از مهم‌ترین چالش‌های حقوقی و سیاسی هر جامعه‌ای می‌تواند باشد. در این میان هرچند مفهوم حقوقی شفافیت، امروزه مفهومی تازه‌وارد است، ولی ریشه‌های مفهوم شفافیت را می‌توان در آموزه‌های علوی به خصوص در دوران کوتاه حکوت ایشان یافت. علی† شفافیت در حکومت را امری ضروری تلقی می‌کرد و به صداقت و صراحت تمام، دیدگاه حکومتی و شیوه عملی خویش را با مردم و همه مخاطبان در میان می‌گذاشت. ایشان جز در مورد اسرار جنگی، پنهان‌کاری از مردم را مجاز نمی‌دانست. در اندیشه علوی، شاخص‌ها و معیارهایی ـ ‌اعم از ساختاری و رفتاری ـ دخیل‌اند تا با فراهم‌سازی مقدمات تحقق‌پذیری شفافیت، خیر عمومی و منافع همگانی را تأمین کنند. اعلام صریح مواضع حکومت، هشدار و آگاهی‌بخشی به کارگزاران، تبیین تکالیف و حقوق متقابل کارگزاران و مردم، لزوم دسترسی آسان به کارگزاران، به‌کارگیری سطح بالایی از استانداردهای درستکاری و اخلاق برای کارکنان، گزارش‌دهی به مردم و تبیین دلائلی تنبیه کارگزاران، شاخص‌های رفتاری یک حکومت شفاف است. همچنین بهره‌گیری از شاخص‌های ساختاری چون شبکه نظارتی گسترده و نظام قضایی مستقل، به خوبی در نیل به شفافیت می‌تواند راهگشا باشد.}, keywords_fa = {اندیشه علوی,حکومت,شفافیت,شاخص ساختاری,شاخص رفتاری}, url = {https://hoquq.iict.ac.ir/article_24123.html}, eprint = {https://hoquq.iict.ac.ir/article_24123_898edcfa9a50b1e1a375f467ec4d33ae.pdf} }
