In the private law the question is whether we can take retaliation verses and vengeance verses, to reach liability and civil liability? In the first part of this article by rejecting those theories which do not accept liability by retaliation verses, this relation between liability and retaliation is reinforced. In the area of ​​criminal law for crimes committed against life and limb, according to the verses of retaliation and retaliation the question is whether we can accept the retaliation for some people in front of one person? And whether this rule can be applied to crimes committed on the non-member injured such as the crimes of desecration of intimidation and coercion? In the second part of the article the rules of retaliation against a person known to be error-free, but the implementation of the principle of non-object in crimes against injured or where the murderer does not have the similar part in his body is considered to be limited to some circumstances. In the area of international law by accepting the principle of retaliation license for an Islamic state based on the verses, the possibility of retaliation between the Islamic State and retaliation of exactly the same abuses were not accepted against the enemy. Because of the "purpose" of civilians and "the direction of" the inhuman behaviors and the use of weapons of mass destruction, these measures are faced restrictions and prohibitions.}, keywords = {Retaliation,Abuse,equal liability,vengeance,retaliation punishment}, title_fa = {قاعده مقابله به مثل در قرآن}, abstract_fa = {جریان قاعده جواز «مقابله به مثل در پرتو قرآن» و بررسی محدودیت‌ها و موانع آن در سه حیطه حقوق خصوصی، حقوق جزا و حقوق بین‌الملل از موضوعات مطرح در نوشتار حاضر است.در حیطه حقوق خصوصی، پرسش اینکه آیا می‌توان از آیات مقابله به مثل و تقاص، به ضمان و مسئولیت مدنی رسید؟ در قسمت اول این نوشتار، با نقد دیدگاهی که دلالت آیات مقابله به مثل را بر ضمان نپذیرفته، دیدگاهی که دلالت آیات بر ضمان را پذیرفته تقویت شده است. در حیطه حقوق جزا، به رغم پذیرش جریان قاعده بر جرایم ارتکابی بر نفس و عضو، با توجه به آیات قصاص و مقابله به مثل این پرسش مطرح می‌باشد که آیا امکان مقابله به مثل چند نفر در مقابل یک نفر وجود دارد؟ آیا این قاعده درباره جرایم ارتکاب‌یافته بر غیرعضو مجنی‌علیه مانند جرایم مربوط به هتک حرمت وی یا تهدید، ارعاب و اکراه او جریان دارد یا خیر؟ در قسمت دوم نوشتار، جریان قاعده در جایی که چند نفر مقابل یک نفر قصاص می‌شوند، بی‌اشکال دانسته شده است؛ ولی اجرای قاعده در مورد جرایم وارده بر غیرجسم مجنی‌علیه یا جایی که جانی، عضو مماثلی در بدن ندارد، با شرایطی دارای محدودیت دانسته شده است. در حیطه حقوق بین‌الملل، با پذیرش اصل جواز مقابله به مثل برای حکومت اسلامی از راه آیات، دیدگاه امکان اقدام متقابل دولت اسلامی و مقابله به مثل، دقیقاً متناظر و مشابه تعدی صورت‌گرفته از جانب دشمن پذیرفته نشده است و اثبات گردیده که جریان قاعده مقابله به مثل، نسبت به غیرنظامیان و با استفاده از روش‌های غیرانسانی و سلاح‌های کشتار جمعی، با محدودیت‌ها و ممنوعیت‌هایی مواجه است.}, keywords_fa = {مقابله به مثل,اعتدا,جزای به مثل,ضمان به مثل,تقاص,قصاص}, url = {https://hoquq.iict.ac.ir/article_19494.html}, eprint = {https://hoquq.iict.ac.ir/article_19494_b7efa9b00a1ccdc8462aba86dc442722.pdf} }
