The relation according to which ‘person’ is regarded as a member of population governed by this government creates rights and obligations for ‘person’. Though, in customary law, nationality is based on the relation between ‘person’ and a certain ‘government’ and its scope is specified by geographical borders, in Islamic rules and laws, nationality has a more extensive sense and its basis is acceptance of Islam (nationality based on faith) or acceptance of Islamic government (contractual nationality). In other words, according to Islamic rules, those will be regarded as citizens of an Islamic government who have converted to Islam or accepted Islamic government and its rules and laws through a contract they have concluded with the leader of Muslims or one of Muslims. This has caused some differences between the nature of nationality according to Islamic rules and laws on the one hand and what that is included in customary law on the other. In this study, the authors try to study ‘nationality’ which has not been so discussed in works of jurists so that it may be clarified who are regarded as citizens of the Islamic government according to Islamic jurisprudence.}, keywords = {Nationality,Government,Islam,nationality based on faith,contractual nationality}, title_fa = {تابعیت در اسلام}, abstract_fa = {یکی از مباحث مهم حقوق بین‌الملل خصوصی اسلام، بحث تابعیت و نوع رابطه «شخص» و «دولت اسلامی» است؛ رابطه ای که به موجب آن «شخص» عضو «جمعیت» این دولت محسوب شده، حقوق و تکالیفی برای او ایجاد می‌شود. اگرچه مبنای تابعیت در حقوق عرفی را رابطه شخص و دولتی معیّن تشکیل می‌دهد و محدوده آن را مرزهای جغرافیایی و قراردادی تعیین می‌کنند؛ ولی در قوانین و مقررات اسلامی، تابعیت معنا و مفهوم گسترده‌تری دارد و مبنای آن را پذیرش اسلام (تابعیت ایمانی) یا قبول حکومت اسلامی و عضویت در آن (تابعیت پیمانی) تشکیل می‌دهد؛ یعنی از دیدگاه مقررات اسلامی، اشخاصی اتباع دولت اسلامی محسوب می‌شوند که اسلام آورده باشند یا تحت عنوان قراردادی که با امام مسلمانان یا یکی از مسلمانان منعقد می‌کنند، حکومت اسلامی و اجرای قوانین آن را پذیرفته باشند. همین امر باعث شده است ماهیت تابعیت در قوانین و مقررات اسلامی با آنچه در حقوق عرفی رایج است، تفاوت‌هایی داشته باشد و در این تحقیق بر آنیم تا بحث تابعیت را که در آثار فقها به آن کمتر اشاره شده است، مورد بررسی قرار دهیم تا روشن شود که از نظر فقه اسلامی، چه کسانی اتباع دولت اسلامی محسوب می‌شوند.}, keywords_fa = {تابعیت,دولت,اسلام,تابعیت ایمانی,تابعیت پیمانی}, url = {https://hoquq.iict.ac.ir/article_13673.html}, eprint = {https://hoquq.iict.ac.ir/article_13673_3049bfa64f3f3fcde278c4048f717382.pdf} }
